United States v. Pascoe, 2024 U.S. Dist. LEXIS 119992 (W.D. Ky. July 9, 2024).<\/p>\n\n\n\n<p>There was probable cause for defendant\u2019s arrest for DUI from having run off the road, smelling of alcohol, and other apparent factors. State v. Davis, 2024 MT 145, 2024 Mont. LEXIS 747 (July 9, 2024).*<\/p>\n\n\n\n<p>Defense counsel filed a Brady motion over discrepancies in the search warrant affidavit, and additional discovery was provided by the government. A motion was filed but never ruled on before defendant pled guilty and waived it. Defendant is incorrect that defense counsel wasn\u2019t effective for not filing such a motion. United States v.
