{"id":5508,"date":"2011-12-28T07:41:48","date_gmt":"2011-05-02T20:40:02","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-05-02T20:40:02","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=5508","title":{"rendered":"CA10: While Fourth Amendment was violated by stops of customers coming from a bar, qualified immunity applied"},"content":{"rendered":"<p>While the officer who stopped customers coming from a bar violated the Fourth Amendment just for sobriety roving checkpoints, he was entitled to qualified immunity because the law was not clearly established. <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/10\/10-7065.pdf\">Kozel v. Duncan<\/a>, 421 Fed. Appx. 843 (10th Cir. 2011) (unpublished)*:<\/p>\n<blockquote><p>We conclude that the district court erred in applying the closely-regulated industries exception to the warrant requirement. The entries into Wranglers were not \u201cadministrative inspections designed to enforce regulatory statutes.\u201d New York v. Burger, 482 U.S. 691, 700 (1987). Rather, given the reports of underage drinking in Wranglers, officers entered in a traditional investigatory capacity for \u201cgathering &#8230; criminal evidence\u201d and enforcing the penal laws. Id.; see also id. at 712-13 (stating that \u201c[a]dministrative statutes and penal laws may have the same ultimate purpose of remedying the social problem, but they have different subsidiary purposes and prescribe different methods of addressing the problem\u201d). Consequently, because this case does not involve administrative inspections, \u201cthe well-established exception to the warrant requirement for administrative inspections of \u2018closely regulated\u2019 businesses,\u201d id. at 712, does not apply. Cf. Ferguson v.
