This is not at all like Carpenter and is more like the beeper in Knotts tracking him in a public place. <a href=\"https:\/\/www.dccourts.gov\/sites\/default\/files\/2022-09\/Kelly%20v%20US%20%2019-CF-481.pdf\">Kelly v. United States<\/a>, 2022 D.C. App. LEXIS 297 (Sep. 1, 2022).<\/p>\n\n\n\n<p>No warrant is needed to forensically test DNA that was abandoned. <a href=\"https:\/\/search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=72ddc653-78dd-4466-91db-1d80428de605&amp;MediaID=716d6007-0ab7-496d-93c7-e7ef779a1f49&amp;coa=COA02&amp;DT=Opinion\">McCurley v. State<\/a>, 2022 Tex. App. LEXIS 6665 (Tex. App. \u2013 Ft. Worth Aug. 31, 2022).<\/p>\n\n\n\n<p>The affidavit for warrant did not violate Franks. The witnesses gave a description that generally fit defendant, despite some contradictions. They also unequivocally identified him from a surveillance video. <a href=\"https:\/\/www.sccourts.org\/opinions\/HTMLFiles\/COA\/5942.pdf\">State v. Brown<\/a>, 2022 S.C. App. LEXIS 103 (Aug. 31, 2022).*<\/p>\n\n\n\n<p>There was probable cause for plaintiff\u2019s arrest, so the officers prevail on summary judgment. Jackson v.
