{"id":5021,"date":"2011-02-01T07:44:22","date_gmt":"2010-12-25T06:51:04","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2010-12-25T06:51:04","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=5021","title":{"rendered":"CA8: RS of drugs on the person = RS armed; coffee filter peeking from pocket supported frisk"},"content":{"rendered":"<p>A coffee filter sticking up from defendant\u2019s pocket during a stop justified his frisk because, in the Eighth Circuit, knowledge of drugs equals dangerousness. <a href=\"http:\/\/www.ca8.uscourts.gov\/opndir\/10\/12\/101299P.pdf\">United States v. Crippen<\/a>, 627 F.3d 1056 (8th Cir. 2010):<\/p>\n<blockquote><p>A suspicion on the part of police that a person is involved in a drug transaction supports a reasonable belief that the person may be armed and dangerous because weapons and violence are frequently associated with drug transactions. <a href=\"http:\/\/scholar.google.com\/scholar_case?case=9776391118828813468&amp;q=396+F.3d+935&amp;hl=en&amp;as_sdt=80002\">United States v. Bustos-Torres<\/a>, 396 F.3d 935, 943 (8th Cir. 2005). The district court found that because Officer Palmer remembered Crippen from the October 2008 search of Conroy&#8217;s house and knew coffee filters are used as part of the methamphetamine manufacturing process, he suspected Crippen was involved in a drug transaction and thus had reasonable suspicion Crippen was armed and dangerous. Accordingly, the pat-down search and seizure of the coffee filter was valid.\n<\/p><\/blockquote>\n<p>Defendant had a MySpace account that was suggestive to others of his being a pedofile and his online \u201cfriends\u201d were all young boys. A search warrant was ultimately issued for defendant\u2019s property. The USMJ concluded that the warrant did not authorize seizure of defendant\u2019s computer, but the USDJ disagreed and overruled. Also, inevitable discovery would apply, as would the good faith exception. United States v. Underwood, 2010 U.S. Dist. LEXIS 134092 (W.D. Ky. December 17, 2010).*<\/p>\n<p>The drug dog arrived while the traffic stop was still going on within eight minutes. The stop was only \u201cas long as necessary.\u201d United States v. McDowell, 2010 U.S. Dist. LEXIS 134010 (D. Kan. December 16, 2010).*<\/p>\n<p>Defendant could not challenge the search of a computer of a person he was communicating with by instant messaging over the internet. United States v. Haffner, 2010 U.S. Dist. LEXIS 134460 (M.D. Fla. August 31, 2010), adopted 2010 U.S. Dist. LEXIS 134453 (M.D. Fla.
