Barnes<\/a>, 2021 U.S. App. LEXIS 24886 (8th Cir. Aug. 20, 2021).<\/p>\n\n\n\n<p>Defense counsel wasn\u2019t ineffective for not filing a motion to suppress that would not have prevailed. Reasonable suspicion here was based on collective knowledge defendant was involved in a homicide, and then a gun with an extended magazine was seen in plain view. <a href=\"http:\/\/publicdocs.courts.mi.gov\/OPINIONS\/FINAL\/COA\/20210819_C354634_43_354634.OPN.PDF\">People v. Benn<\/a>, 2021 Mich. App. LEXIS 4978 (Aug. 19. 2021).*<\/p>\n\n\n\n<p>Overtinted windows was an adequate basis for defendant\u2019s stop, even if pretextual.
