Scharborough<\/a>, 2020 NY Slip Op 08124, 2020 N.Y. App. Div. LEXIS 8319 (3d Dept. Dec. 31, 2020).<\/p>\n\n\n\n<p>\u201c[A]n officer approaching a parked car and questioning the driver more closely resembles an officer approaching a pedestrian on the sidewalk.\u201d The contact was consensual and not a traffic stop. A gun was seen in plain view, and that justified a vehicle search. United States v. Butler, 2020 U.S. Dist. LEXIS 245053 (E.D. Va.
