{"id":453,"date":"2007-01-24T12:01:33","date_gmt":"2006-09-26T07:46:58","guid":{"rendered":""},"modified":"2017-09-17T13:42:27","modified_gmt":"2017-09-17T18:42:27","slug":"en-us-151","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=453","title":{"rendered":""},"content":{"rendered":"<p>Creation of a &#8220;juvenile report&#8221; after a juvenile arrest, arising here in the context of a \u00a7 1983 case, states no claim whatsoever. &#8220;Febres and Padouvas contend, on behalf of the putative Juvenile Class, that the execution of a Juvenile Report constitutes a &#8216;constructive seizure&#8217; in violation of their Fourth Amendment rights. (See 3d Am. Compl. \u00b6\u00b6 20, 183.) Yet, while a &#8216;seizure&#8217; of the Juvenile Plaintiffs may have occurred at some point in connection with the circumstances giving rise to the execution of Juvenile Reports, these plaintiffs have not offered, nor can the Court find, any legal support for the proposition that the execution of a Juvenile Report itself constitutes a seizure that is subject to the protections of the Fourth Amendment.&#8221;  Febres v. City of New York, 238 F.R.D. 377 (S.D. N.Y.
