Some was forfeited, and it was treated as a motion to set aside the forfeitures. Some were not forfeited, and there is no statute of limitations for equitable relief for return of property. Motion to dismiss granted against the forfeited and denied against the non-forfeited. <a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2019cv2039-33\">Ford-Bey v. United States<\/a>, 2020 U.S. Dist. LEXIS 1583 (D.D.C. Jan. 2, 2020).<\/p>\n<p>In challenging the R&#038;R, defendant\u2019s only claim is that the officers weren\u2019t credible, but the USMJ found that they were. That\u2019s the USMJ\u2019s job. Even with de novo review, their testimony appears credible. United States v. Tillard, 2020 U.S. Dist. LEXIS 1539 (W.D. N.Y.
