He was to be arrested for that and he resisted. He raised on appeal that his arrest was unlawful; so therefore his arrest for resisting arrest was unlawful. He didn\u2019t raise that in the trial court and can\u2019t on appeal. <a href=\"https:\/\/appellate.nccourts.org\/opinions\/?c=2&#038;pdf=38408\">State v. Pavkovic<\/a>, 2019 N.C. App. LEXIS 761 (Sept. 17, 2019).<\/p>\n<p>Petitioner\u2019s proffer does not show an egregious violation of the Fourth Amendment to allow the exclusionary rule to apply to immigration searches. <a href=\"http:\/\/cdn.ca9.uscourts.gov\/datastore\/memoranda\/2019\/09\/16\/15-72412.pdf\">Euceda v.
