Accordingly, Huerta has abandoned this issue on appeal. See Yohey v. Collins, 985 F.2d 222, 224-25 (5th Cir. 1993).\u201d Not arguing both leaves one as an independent basis, and that makes the issue moot. <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions\/unpub\/18\/18-40645.0.pdf\">United States v.
