The government&#8217;s testing constituted a warrantless search of his blood sample in violation of the Fourth Amendment and no exception to the warrant requirement applied. <a href=\"http:\/\/search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=b60e2ecf-4251-499a-a723-4b9d6516f951&#038;coa=coscca&#038;DT=OPINION&#038;MediaID=85f14dbd-4c6d-4f4c-9f4d-814984152f5e\">State v. Martinez<\/a>, 2019 Tex. Crim. App. LEXIS 237 (Mar. 20, 2019).<\/p>\n<p>The affidavit for defendant\u2019s search warrant failed to show probable cause, and the search had to be suppressed. The officers received information from a CI but days of surveillance were unproductive. They applied for a search warrant anyway.
