Tax LEXIS 100 (July 31, 2018).*<\/p>\n<p>In a sham marriage case, the Ninth Circuit held the district court improperly extended the sham marriage exception into the marital privilege and remanded. Defendant\u2019s Fourth Amendment claim that he had a reasonable expectation of privacy in conversations with his alleged sham wife when she recorded them for the government is also vacated and remanded to be revisited later. <a href=\"http:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2018\/08\/08\/16-50227.pdf\">United States v.
