{"id":333,"date":"2006-09-04T20:55:02","date_gmt":"2006-08-19T14:14:45","guid":{"rendered":""},"modified":"2017-09-17T13:46:58","modified_gmt":"2017-09-17T18:46:58","slug":"en-us-311","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=333","title":{"rendered":"Call to Mother from Interrogation Room Admitted as Evidence"},"content":{"rendered":"<p>In an article on <a href=\"http:\/\/www.law.com\/jsp\/article.jsp?id=1155648410675\">Law.com<\/a> on August 16th, the trial judge admitted the defendant&#8217;s end of a telephone call to his mother he made while in the interrogation room after his interrogators left, leaving the tape recorder running.<\/p>\n<p>He claimed no recollection of the shooting, but he told his mother &#8220;He tried to grab the gun, and I pulled away and it went off.&#8221; <\/p>\n<p>The article mentions nothing about any reasonable expectation of privacy in a telephone call from an interrogation room, but it is obvious there would be none.  <\/p>\n<p>I had the good fortune of having such a recording turned over by the state they made when they hoped to get some admission of a shooting death that the client was saying was accidental.
