App. LEXIS 67 (Feb. 14, 2018).<\/p>\n<p>The circuit court erred in granting a defendant\u2019s motion for return of property based on two attached documents where the state didn\u2019t even get a chance to respond. The facts were in dispute on whether the money was evidence or forfeitable. The state claimed it was evidence for defendant\u2019s drug trial. <a href=\"https:\/\/edca.2dca.org\/DCADocs\/2017\/2671\/172671_39_02142018_08362799_i.pdf\">Clayton v. State<\/a>, 2018 Fla.
