The TBI forensic team are not adjudicators in the <a href=\"https:\/\/scholar.google.com\/scholar_case?case=15069922377115925017&#038;q=tumey+v+ohio&#038;hl=en&#038;as_sdt=1006\">Tumey<\/a>&#8211;<a href=\"https:\/\/scholar.google.com\/scholar_case?case=11945799946510807181&#038;q=ward+v+monroeville&#038;hl=en&#038;as_sdt=1006\">Ward<\/a> due process analysis, but it is clear that contingent fee expert witnesses are barred in Tennessee. <a href=\"http:\/\/www.tsc.state.tn.us\/sites\/default\/files\/rosemary_decosimo_opinion.pdf\">State v. Decosimo<\/a>, 2018 Tenn. Crim. App. LEXIS 85 (Feb. 6, 2018).*<\/p>\n<p>2255 petitioner doesn\u2019t show that his lawyer was ineffective for not challenging the search because it would have failed. He raises knock-and-announce, but that would fail under Hudson, and he raises failure to present the warrant before the search which isn\u2019t constitutionally required. Williams v.
