Some people argue that searches and seizures without warrants are unreasonable, except in limited circumstances.\u00a0 Others argue that searches and seizures do not require warrants under any circumstances.\u00a0 Instead such warrants were used as a defense by government officials against tort claims for illegal searches and therefore were restricted to certain situations.<\/p>\n<p>Interestingly, the original version of the Fourth Amendment did not have this structure.\u00a0 James Madison\u2019s proposed version of what would become the Fourth Amendment provided:<\/p>\n<blockquote><p>The rights of the people to be secured in their persons; their houses, their papers, and their other property, from all unreasonable searches and seizures, shall not be violated by warrants issued without probable cause, supported by oath or affirmation, or not particularly describing the places to be searched, or the persons or things to be seized.\n<\/p><\/blockquote>\n<p>Madison\u2019s provision only provides protection from certain kinds of warrants \u2013 the protection provided by the prohibition clause.\u00a0 While it includes the language of the rights clause, this language does not confer that right independently.\u00a0 Instead, Madison\u2019s provision merely states that the right can be violated by violating the prohibition clause.\u00a0 In fact, the rights clause narrows the scope of the prohibition clause by limiting it to \u201cpersons, houses, papers, and other property.\u201d<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Library of Law and Liberty: The Legislative History of the Fourth Amendment: Unreasonable Searches and General Warrants by Mike Rappaport:<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-28966","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"_links":{"self":[{"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/posts\/28966","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=28966"}],"version-history":[{"count":1,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/posts\/28966\/revisions"}],"predecessor-version":[{"id":28967,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=\/wp\/v2\/posts\/28966\/revisions\/28967"}],"wp:attachment":[{"href":"https:\/\/fourthamendment.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=28966"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=28966"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/fourthamendment.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=28966"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
