There had been no burglary call which indicates recency. Thus, the entry violated the Fourth Amendment. <a href=\"https:\/\/appellate.nccourts.org\/opinions\/?c=2&#038;pdf=32616\">State v. Jordan<\/a>, 2015 N.C. App. LEXIS 668 (August 4, 2015).<\/p>\n<p>Defendant\u2019s 2009 blood draw was governed by 2013&#8217;s McNeely and a warrant should have been obtained. <a href=\"http:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=bdbc70e0-15fa-4739-b088-bf86d8c781bb&#038;MediaID=a5910523-f824-4dad-81ce-56ddd1b53261&#038;coa=%22%20+%20this.CurrentWebState.CurrentCourt%20+%20@%22&#038;DT=Opinion\">State v. Munoz<\/a>, 2015 Tex. App. LEXIS 8109 (Tex.App.\u2013El Paso July 31, 2015).*<\/p>\n<p>Pulling into a Hardee\u2019s parking lot to inquire of the defendant who was sitting in a car parked near the dumpster while the restaurant was closed was a stop without reasonable suspicion.
