The charging document had to allege sufficient facts to show that the entry was permitted to support the charge, and this one did not. <a href=\"http:\/\/www.courts.state.ny.us\/reporter\/3dseries\/2008\/2008_28047.htm\">People v. Rodriquez<\/a>, 19 Misc. 3d 302, 851 N.Y.S.2d 342 (2008). (<em>Comment:<\/em> The way this opinion reads, the gap in the proof gives the prosecution the opportunity to allege sufficient facts to at least make the charge stick, if they have them.)<\/p>\n<p>Furtive movement of reaching toward one&#8217;s back can alone be reasonable suspicion when the officer is alone and outnumbered. <a href=\"http:\/\/www.wicourts.gov\/ca\/opinion\/DisplayDocument.pdf?content=pdf&amp;seqNo=31785\">State v.
