{"id":1429,"date":"2007-10-24T05:26:37","date_gmt":"2007-10-08T06:58:32","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2007-10-08T06:58:32","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=1429","title":{"rendered":"NY Immigration Judge: Profiling Middle-Eastern man for immigration stop justified suppression"},"content":{"rendered":"<p>Posted on <a href=\"http:\/\/bibdaily.com\/pdfs\/10-3-07%20suppression%20NY%20IJ%20Sichel.pdf\">Bender&#8217;s Immigration Bulletin&#8211;Daily Edition<\/a>, an immigration judge in NYC on October 3d held in a removal proceeding that the alien was profile stopped without justification. While the Fourth Amendment exclusionary rule does not apply to removal proceedings (<a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=468&amp;invol=1032\"><em>INS v. Lopez-Mendoza<\/em><\/a>), this stop rose to the level of a due process violation.
