See <a href=\"http:\/\/www.scotusblog.com\/2014\/01\/court-to-rule-on-cellphone-privacy\/\">Court to rule on cellphone privacy<\/a> on SCOTUSBlog. <\/p>\n<p>I&#8217;m going to go out on a limb here: Can a smartphone (a <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=ca8_cell_phone_is_computer_for_u_s_s_g_p&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">computer<\/a>) capable of holding a million pages of documents and a few hundred thousand photographs be compared to the crumbled cigarette pack in 1973&#8217;s <a href=\"http:\/\/scholar.google.com\/scholar_case?case=5387812968771120977&amp;q=united+states+v.+robinson&amp;hl=en&amp;as_sdt=1002\">Robinson<\/a>? To ask is to answer. No.<\/p>\n<p><strong>Update:<\/strong> Here, if a cell phone was seized, I assume it was dumped into the police computer whether the discovery mentions it or not. Too many times I&#8217;ve read about seized cell phones and the police bragging about their electronic toys to copy phones. Twice I&#8217;ve had clients arrested and released (&#8220;catch and release&#8221;) where the police held the cell phone for about two hours and returned it.
