At issue is whether police can search mobile devices upon arrest without getting a warrant &#8212; and whether the data inside, from e-mail to the Internet, are fair game. For the court, it&#8217;s the latest in a string of Fourth Amendment search and seizure cases involving innovation. <\/p><\/blockquote>\n<p>I&#8217;ve been noting with amusement the people writing on the Internet with their proverbial &#8220;hair on fire&#8221; about the Government&#8217;s cert petition in Wurie (<a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=gov_t_seeks_cert_in_warrantless_cell_pho&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">post here<\/a>) that the &#8220;Obama Justice Department wants to have the power to search cell phones incident to arrest.&#8221; Since they obviously haven&#8217;t been paying attention to the case law, please note this: The number of cases holding that the government already <em>can<\/em> search a cell phone incident to arrest outnumber the ones saying it can&#8217;t about 7-1. Wurie is the first federal circuit to adopt the rational rule and say no. That makes a conflict in the circuits, and that makes the cert petition news.
