{"id":869,"date":"2007-06-19T10:34:54","date_gmt":"2007-03-24T07:53:04","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2007-03-24T07:53:04","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=869","title":{"rendered":"California medical marijuana law is a defense to prosecution but not to limited investigations with probable cause"},"content":{"rendered":"<p>&#8220;Following the denial of his motion to suppress, defendant Gabriel Reed Strasburg pleaded no contest to misdemeanor possession of more than 28.5 grams of marijuana (Health &amp; Saf. Code, \u00a7 11357, subd. (c)). He contends that the sheriff&#8217;s deputy who seized the marijuana lacked probable cause to search his car because defendant was allowed to possess marijuana under the Compassionate Use Act of 1996 (Health &amp; Saf. Code, \u00a7 11362.5). We disagree because the Compassionate Use Act provides a limited defense against prosecution, but does not provide a shield against reasonable investigations and searches. Accordingly, we affirm.&#8221;  People v. Strasburg, 148 Cal. App. 4th 1052, 56 Cal. Rptr. 3d 306 (1st Dist. 2007).<\/p>\n<p>Officer had probable cause to arrest defendant based on the totality of the circumstances, particularly where police officer personally observed the occurrence of the crime and also executed the arrest. Haley v. State, 398 Md. 106, 919 A.2d 1200 (2007).*<\/p>\n<p>Officers had qualified immunity for detaining the plaintiff based on reasonable suspicion. Quirk v. Blocher, 2007 U.S. Dist. LEXIS 19733 (S.D. Ind. March 19, 2007).*<\/p>\n<p>Plaintiff&#8217;s cause of action accrued on his arrest, not when he received a videotape that supported the claim. Watts v. Epps, 2006 U.S. Dist. LEXIS 95731 (N.D. Ga.
