{"id":8583,"date":"2013-04-06T10:46:35","date_gmt":"2013-04-06T10:46:35","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2013-04-06T10:46:35","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=8583","title":{"rendered":"CNET.com: Google fights FBI&#8217;s warrantless data requests in federal court"},"content":{"rendered":"<p>CNET.com: <a href=\"http:\/\/news.cnet.com\/8301-13578_3-57577958-38\/google-fights-fbis-warrantless-data-requests-in-federal-court\/\">Google fights FBI&#8217;s warrantless data requests in federal court<\/a> by Declan McCullagh <\/p>\n<p>It&#8217;s the first major company to openly challenge FBI&#8217;s warrantless data-gathering known as national security letters, which authorize a gag order ruled unconstitutional by a federal judge.<\/p>\n<p><!--more--><\/p>\n<blockquote><p>Google has undertaken what appears to be a legal first: an open court challenge by a major Internet company to a warrantless electronic data-gathering technique used by the FBI.<\/p>\n<p>The company asked U.S. District Judge Susan Illston in San Francisco last week to grant a &#8220;petition to set aside legal process&#8221; in response to a national security letter it received from the FBI.<\/p>\n<p>National security letters allow FBI officials to send a secret request to Web and telecommunications companies requesting &#8220;name, address, length of service,&#8221; and other information about users as long as it&#8217;s relevant to a national security investigation.
