Smith<\/a>, 124 Ohio St.3d 163, 2009 Ohio 6426, 920 N.E.2d 949 (2009), a warrant is not required if the cell phone is abandoned. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/2\/2012\/2012-ohio-6046.pdf\">State v. Moten<\/a>, 2012 Ohio 6046, 2012 Ohio App. LEXIS 5204 (2d Dist. December 21, 2012).<\/p>\n<p>A pre-<a href=\"http:\/\/scholar.google.com\/scholar_case?case=4755468061403609564&amp;q=gant&amp;hl=en&amp;as_sdt=2,10\">Gant<\/a> search that was valid under <a href=\"http:\/\/scholar.google.com\/scholar_case?case=8983182669917326592&amp;q=belton&amp;hl=en&amp;as_sdt=2,10\">Belton<\/a> but not <a href=\"http:\/\/scholar.google.com\/scholar_case?case=4755468061403609564&amp;q=gant&amp;hl=en&amp;as_sdt=2,10\">Gant<\/a> was still valid under <a href=\"http:\/\/www.supremecourt.gov\/opinions\/10pdf\/09-11328.pdf\">Davis v. United States<\/a>\u2019s good faith exception. <a href=\"http:\/\/www.judicial.state.sc.us\/opinions\/HTMLFiles\/SC\/27202.pdf\">State v.
