{"id":6697,"date":"2012-02-18T14:56:19","date_gmt":"2012-02-18T14:56:19","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2012-02-18T14:56:19","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=6697","title":{"rendered":"JURIST: &#8220;FISA and the Battle Between National Security and Privacy&#8221;"},"content":{"rendered":"<p>JURIST: <a href=\"http:\/\/jurist.org\/forum\/2012\/02\/jimmy-gurule-fisa.php\">FISA and the Battle Between National Security and Privacy<\/a> by <a href=\"http:\/\/law.nd.edu\/people\/faculty-and-administration\/teaching-and-research-faculty\/jimmy-gurule\/\">Jimmy Gurul\u00e9<\/a>:<\/p>\n<blockquote><p>Defendant Mohanad Shareef Hammadi, an Iraqi citizen who was granted refugee status under the Refugee Admissions Program and resided in Bowling Green, Kentucky, was <a href=\"http:\/\/jurist.org\/paperchase\/2012\/02\/federal-judge-allows-secret-evidence-in-al-qaeda-trial.php\">arrested and charged<\/a> with 10 terrorism-related offenses. The indictment alleged that Hammadi and a co-defendant attempted to provide material support and resources to members of al Qaeda in Iraq, a designated foreign terrorist organization, including rocket-propelled grenade launchers, hand grenades, machine guns, cases of C4 plastic explosives, sniper rifles and money, to be used in the preparation for and killing of Americans located outside the US. Hammadi and his co-defendant were also charged with attempting to provide two Stinger surface-to-air missile launcher systems to al Qaeda in Iraq for the purpose of killing Americans abroad. <\/p>\n<p>Prior to trial, Hammadi filed a motion to disclose and suppress evidence obtained pursuant to electronic surveillance and a physical search authorized under the <a href=\"http:\/\/www.law.cornell.edu\/uscode\/text\/50\/chapter-36\">Foreign Intelligence Surveillance Act<\/a> (FISA).
