Rand Paul (R-KY), <a href=\"http:\/\/www.rawstory.com\/rs\/2012\/01\/23\/rand-paul-detained-by-tsa-in-nashville\/\">claimed last week<\/a> that he had been \u201cdetained\u201d by the TSA for refusing an intrusive pat down at an airport in Nashville, Tennessee.<\/p>\n<p>. . .<\/p>\n<p>In 1973, the U.S. Court of Appeals for the Ninth Circuit ruled that the Fourth Amendment did not apply to airport security, \u201cnoting that airport screenings are considered to be administrative searches because they are conducted as part of a general regulatory scheme, where the essential administrative purpose is to prevent the carrying of weapons or explosives aboard aircraft.\u201d<\/p>\n<p>Paul did not say how privatizing airport screenings would circumvent the Ninth Circuit\u2019s [1973] ruling [that the Fourth Amendment doesn&#8217;t apply to airport screenings].<\/p>\n<p>Watch this video from Fox\u2019s Fox News Sunday, broadcast Jan. 29, 2012.\n<\/p><\/blockquote>\n<p>[Note: If private actors fulfilling a government function violate the Fourth Amendment, what difference does it make?
