{"id":6546,"date":"2012-05-01T09:46:13","date_gmt":"2012-01-15T11:08:11","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2012-01-15T11:08:11","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=6546","title":{"rendered":"CA4: Seven cars outside house on arrest justified a protective sweep"},"content":{"rendered":"<p>The fact there were seven cars parked outside defendants\u2019 property justified a <a href=\"http:\/\/scholar.google.com\/scholar_case?case=14617911839617855186&amp;q=buie&amp;hl=en&amp;as_sdt=20002\">protective sweep<\/a> when there was an arrest of two on the property. <a href=\"http:\/\/pacer.ca4.uscourts.gov\/opinion.pdf\/104442.P.pdf\">United States v. Jones<\/a>, 667 F.3d 477 (4th Cir. 2012).*<\/p>\n<p>Plaintiffs are California Sexual Violent Predators who sued their keepers with a Fourth Amendment claim that alleged that defendants&#8217; policies, practices and customs subjected plaintiffs to unreasonable searches, searches as a form of punishment, degrading public strip searches, improper seizures of personal belongings, and the use of unreasonable force and physical restraints. But there was no allegation of a specific policy implemented by defendants or a specific event or events instigated by defendants that led to these purportedly unconstitutional searches, so the district court properly granted judgment for defendants. <a href=\"http:\/\/www.ca9.uscourts.gov\/datastore\/opinions\/2012\/01\/12\/03-56712.pdf\">Hydrick v. Hunter<\/a>, 669 F.3d 937 (9th Cir. 2012).*<\/p>\n<p>A juvenile hanging around in the backyard of an abandoned house was reasonable suspicion of a trespass. As the officers approached, he abandoned a handgun. <a href=\"http:\/\/www.la4th.org\/opinion\/2011\/294321.pdf\">State in Interest of P.L.<\/a>, 81 So. 3d 983 (La.
