The officer was suspicious of defendant\u2019s driving having followed him, and the officer tried to initiate the stop on the roadway. People v. Madden, 2026 Mich. App. LEXIS 8402 (Oct. 2, 2026):<\/p>\n\n\n\n<!--more-->\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Despite the fact that this case and Collins both involve a seizure that occurred in the curtilage of a residence, this case is distinguishable from Collins because the attempted seizure in this matter was initiated on the roadway when the officer illuminated her vehicle&#8217;s overhead lights, approximately 9 to 10 seconds before he turned into his driveway, as discussed above. The search of the suspected stolen motorcycle in Collins occurred days or weeks after that motorcycle was suspected to have been involved in two separate traffic incidents and it occurred solely in the curtilage of the defendant&#8217;s residence.<\/p>\n<\/blockquote>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Defendant was not improperly stopped in his curtilage.
