Jerry Brown earlier this month vetoed <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=cnn_com_california_bill_would_ban_warran&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">Senate Bill 914<\/a> \u2014 which would have overturned a California Supreme Court decision giving police the power to search arrestees&#8217; cellphones without a warrant \u2014 he said courts are &#8220;better suited&#8221; to draw such lines.<\/p>\n<p>Not everybody&#8217;s so sure.<\/p>\n<p>&#8220;I think Gov. Brown has it exactly backwards,&#8221; wrote George Washington University law professor Orin Kerr, a privacy rights expert, on The Volokh Conspiracy blog. &#8220;It is very difficult for courts to decide Fourth Amendment cases involving developing technologies like cellphones.&#8221;<\/p>\n<p>As emerging technologies upend societal expectations of privacy, some legal experts point to <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=cal_cell_phone_may_be_searched_incident_&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">People v. Diaz<\/a> as the latest example that courts are ill-equipped to adapt to that reality.
