This was a waiver of the issue. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/7\/2011\/2011-ohio-5133.pdf\">State v. Stoffer<\/a>, 2011 Ohio 5133, 2011 Ohio App. LEXIS 4234 (7th Dist. September 30, 2011).*<\/p>\n<p>Defendant was being followed because of a report of impaired driving, but there were no signs of impaired driving. So, the officer stopped defendant because of his muffler as a pretext, and that made the stop invalid. <a href=\"http:\/\/www.courts.wa.gov\/opinions\/index.cfm?fa=opinions.showOpinion&amp;filename=291642MAJ\">State v. Arreola<\/a>, 163 Wn. App. 787, 260 P.3d 985 (2011).*<\/p>\n<p>Summary judgment on consent to search issue against pro se plaintiff was affirmed. <a href=\"http:\/\/www.ca9.uscourts.gov\/datastore\/memoranda\/2011\/10\/03\/10-16206.pdf\">Feaster v. Las Vegas Metro. Police Dep&#8217;t<\/a>, 451 Fed. Appx. 663 (9th Cir. 2011).*<\/p>\n<p>The USMJ\u2019s credibility determinations are upheld. Because the officer did not have a crystal clear memory about what happened with another person at the scene did not undermine his testimony about the defendant. United States v. Ragland, 2011 U.S. Dist. LEXIS 114148 (D. Md.
