The officer surveilled the apartment and saw him coming and going at least twice. This was sufficient under <a href=\"http:\/\/scholar.google.com\/scholar_case?case=14936388408511643149&amp;q=payton+v.+new+york&amp;hl=en&amp;as_sdt=2,4\">Payton<\/a>. <a href=\"http:\/\/www.ca11.uscourts.gov\/unpub\/ops\/201011087.pdf\">United States v. Weeks<\/a>, 442 Fed. Appx. 447 (11th Cir. 2011) (unpublished).<\/p>\n<p>The officer confirmed with dispatch that defendant did not have a valid DL, and that justified the stop. Defendant\u2019s passing reference to the legality of the search of the car was a mere passing reference without authority, and it is deemed abandoned. <a href=\"http:\/\/www.ca11.uscourts.gov\/unpub\/ops\/201014098.pdf\">United States v. Gardner<\/a>, 444 Fed. Appx. 361 (11th Cir. 2011) (unpublished).*<\/p>\n<p>The officer testified that the dog alerted on a free-air search around the vehicle. The defendant argued that the dog stuck his nose in an open window. Defendant did not satisfy his appellate burden of showing that the search was invalid. <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/10\/10-5167.pdf\">United States v. Ayala<\/a>, 446 Fed.
