But there should be a check against what Judge Alex Kozinski of the California federal appeals court called the possibility of <a href=\"http:\/\/www.nytimes.com\/2010\/08\/14\/us\/14gps.html\">\u201ccreepy and un-American\u201d<\/a> government acts.
