State Sportsmen&#8217;s Ass&#8217;n v. Del. Dep&#8217;t of Safety &amp; Homeland Sec.<\/a>, 2024 U.S. App. LEXIS 17214 (3d Cir. July 15, 2024).<\/p>\n\n\n\n<p>\u201cNor is it the goal of a Franks hearing for a defendant to raise an \u2018attack\u2019 on an affidavit through \u2018conclusory\u2019 allegations \u2018supported by [only] a mere desire to cross-examine.\u2019 See Franks, 438 U.S. at 171. Because the Franks motion would not have succeeded, it was not deficient performance not to file it and the failure did not cause Mayer prejudice. See Denson, 804 F.3d at 1342. For the same reasons, Mayer&#8217;s counsel&#8217;s decision not to file the motion can be considered a sound strategic decision, further cementing that it was not deficient performance. See Chandler, 218 F.3d at 1314.\u201d Mayer v. United States, 2024 U.S. App. LEXIS 17240 (11th Cir. July 15, 2024).*<\/p>\n\n\n\n<p>A false imprisonment claim is a \u201cnew context\u201d for Bivens and is dismissed. Summary judgment on the FTCA claim is affirmed, too. Hornof v.
