{"id":5808,"date":"2012-02-01T14:43:49","date_gmt":"2011-07-22T07:23:33","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-07-22T07:23:33","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=5808","title":{"rendered":"CA5: Person not owner of vehicle had no standing to contest placement of GPS on it"},"content":{"rendered":"<p>Defendant was neither the owner of the vehicle nor the target of the investigation, and he had no standing to challenge placing a GPS device on the truck. <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions%5Cpub%5C10\/10-10695-CR0.wpd.pdf\">United States v. Hernandez<\/a>, 647 F.3d 216 (5th Cir. 2011):<\/p>\n<blockquote><p>Moreover, the government did not place the GPS device with the intent of tracking Hernandez. (Angel, on the other hand, was under court-approved surveillance by wiretaps.) There is no suggestion that the government knew Hernandez would drive the truck to California on a drug run. Hernandez \u201chas the burden of establishing that his own Fourth Amendment rights were violated by the challenged search or seizure.\u201d Rakas, 439 U.S. at 130 n.1. He has not demonstrated that he had \u201ca legitimate expectation of privacy in the invaded place.\u201d Rakas, 439 U.S. at 143. Any expectation of privacy he might have is not based in \u201cconcepts of real or personal property law\u201d or \u201cunderstandings that are recognized and permitted by society.\u201d Carter, 525 U.S. at 88. Thus, Hernandez lacks standing to challenge the placement of the GPS device.<\/p><\/blockquote>\n<p>Warrant for a particular place with the plaintiff\u2019s logo on the door within a multiple occupancy building satisfied the particularity requirement of the Fourth Amendment. The officer had been investigating the target for two years. <a href=\"http:\/\/www.ca11.uscourts.gov\/unpub\/ops\/201013215.pdf\">Signature Pharmacy, Inc. v. Wright<\/a>, 438 Fed.
