Crudo<\/a>, 2024 Kan. LEXIS 4 (Jan. 12, 2024).<\/p>\n\n\n\n<p>The \u201cRodriguez moment\u201d came when the officer asked for consent to search. On the totality, the officer had reasonable suspicion to continue the stop. Each piece, maybe not, but it\u2019s not \u201cdivide and conquer.\u201d On the totality, yes. United States v. Miller, 2024 U.S. Dist. LEXIS 4952 (E.D. Pa. Jan. 10, 2024).*<\/p>\n\n\n\n<p>2255 petitioner didn\u2019t challenge his body cavity search in the district court, and he had a \u201cfull and fair opportunity\u201d to litigate it. He appealed and that was denied. His 2255 fails under Stone and on the merits of the search as to ineffective assistance of counsel. McClinton v. United States, 2024 U.S. Dist. LEXIS 5470 (W.D.N.C.
