{"id":5627,"date":"2011-12-28T18:20:10","date_gmt":"2011-06-06T06:46:38","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-06-06T06:46:38","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=5627","title":{"rendered":"CA5: Plaintiff stated claim against TX DFPS for Fourth Amendment violation"},"content":{"rendered":"<p>At this stage of the pleadings, plaintiff stated a claim for relief for DFPS violating their clearly established Fourth Amendment rights in the entry of defendants\u2019 home without alleged consent, exigent circumstances, or special needs. <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions%5Cunpub%5C10\/10-10405.0.wpd.pdf\">Thomas v. Tex. Dep\u2019t of Family &amp; Protective Servs.<\/a>, 427 Fed. Appx. 309 (5th Cir. 2011) (unpublished):<\/p>\n<blockquote><p>We first inquire whether any of the alleged violations, as stated, would represent a violation of Appellants\u2019 Fourth and Fourteenth Amendment rights. In this Circuit, it is \u201cwell established &#8230; that the Fourth Amendment regulates social workers\u2019 civil investigations.\u201d Gates v. Tex. Dep\u2019t of Protective &amp; Regulatory Servs., 537 F.3d 404, 420 (5th Cir. 2008) (citing Roe, 299 F.3d at 401). We have further noted that \u201c[w]arrantless searches of a person&#8217;s home are presumptively unreasonable unless the person consents, or unless probable cause and exigent circumstances justify the search.\u201d Id. (quoting United States v. Gomez-Moreno, 479 F.3d 350, 354 (5th Cir. 2007)) (alteration in Gates).
