Sept. 5, 2023).<\/p>\n\n\n\n<p>The warrant completely lacked probable cause a gun would be found in defendant\u2019s house. \u201cOfficer Benjamin prepared the affidavit and executed the warrant. As a reasonably well-trained officer, Benjamin would recognize that the affidavit that he presented to the Magistrate was inadequate.\u201d People of the V.I. v. Pryce, 2023 VI SUPER 52U, 2023 V.I. Aug. 23, 2023) (unpublished).*<\/p>\n\n\n\n<p>A state statute prohibiting stops for defective equipment and having a statutory exclusionary rule was not retroactive to a stop occurring before it was effective.
