{"id":5506,"date":"2011-09-30T11:39:29","date_gmt":"2011-05-02T20:12:18","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-05-02T20:12:18","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=5506","title":{"rendered":"FL1 declines to follow Ohio&#8217;s <em>Smith<\/em> and finds that cell phone is subject to search incident as a &#8220;container&#8221;"},"content":{"rendered":"<p>FL1 declines to follow Ohio\u2019s <a href=\"http:\/\/scholar.google.com\/scholar_case?case=7332894197687950017&amp;q=124+Ohio+St.+3d+163&amp;hl=en&amp;as_sdt=2,4\">Smith<\/a> case and holds that a cell phone can be the subject of a search incident. The case surveys many cases on both sides of the issue. <a href=\"http:\/\/opinions.1dca.org\/written\/opinions2011\/04-29-2011\/09-3469.pdf\">Smallwood v. State<\/a>, Smallwood v. State, 61 So. 3d 448 (Fla. 1st DCA 2011):<\/p>\n<blockquote><p>While Chimel, Robinson and Belton permitted the search and inspection of items within the arrestee\u2019s reach, including containers, none of these cases required an item to be a \u201ccontainer,\u201d as opposed to some other type of item, in order to be searched upon arrest. Thus, whether or not a cell phone is properly characterized as a traditional \u201ccontainer\u201d is irrelevant to whether or not it is searchable upon arrest. The Supreme Court has clearly and repeatedly found that anything found on an arrestee or within an arrestee\u2019s immediate control may be searched and inspected upon arrest. There is nothing in the language of any of these cases that would permit this court to find an exception for cell phones.
