{"id":5399,"date":"2011-04-06T22:37:23","date_gmt":"2011-04-06T22:36:08","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-04-06T22:36:08","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=5399","title":{"rendered":"CNET: &#8220;Justice Department opposes digital privacy reforms&#8221; on cloud computing protections"},"content":{"rendered":"<p>On CNET.com: <a href=\"http:\/\/news.cnet.com\/8301-31921_3-20051461-281.html#ixzz1InhnbAfY\">Justice Department opposes digital privacy reforms<\/a> by Declan McCullagh <\/p>\n<blockquote><p>The U.S. Justice Department today offered what amounts to a frontal attack on proposals to amend federal law to better protect Americans&#8217; privacy. <\/p>\n<p>James Baker, the associate deputy attorney general, warned that rewriting a 1986 privacy law to grant cloud computing users more privacy protections and to require court approval before tracking Americans&#8217; cell phones would hinder police investigations. <\/p>\n<p>This appears the first time that the Justice Department has publicly responded to a set of digital privacy proposals unveiled last year by a coalition of businesses and advocacy groups including AT&amp;T, Google, Microsoft, eBay, the American Civil Liberties Union, and Americans for Tax Reform. <\/p>\n<p>. . .<\/p>\n<p>The question at hand is rewriting the <a href=\"http:\/\/it.ojp.gov\/default.aspx?area=privacy&amp;page=1285\">Electronic Communications Privacy Act<\/a>, or ECPA, which was enacted in the pre-Internet era of telephone modems and is so notoriously convoluted, it&#8217;s difficult even for judges to follow. <\/p>\n<p>The Digital Due Process coalition hopes to simplify the wording while requiring police to obtain a search warrant to access private communications and the locations of mobile devices&#8211;which is not always the case today.
