Oct. 24, 2022).*<\/p>\n\n\n\n<p>A criminal defendant can\u2019t sue his lawyer under \u00a7 1983 for not opposing taking a buccal swab for DNA. Braithwaite v. Gaitman, 2022 U.S. Dist. LEXIS 193506 (E.D.N.Y. Oct. 24, 2022).*<\/p>\n\n\n\n<p>Defense counsel wasn\u2019t ineffective for not challenging the search warrant for defendant\u2019s phone records because there was probable cause for the warrant independent of the specific challenge he makes.
