The state did not raise this issue in the trial court, which the court said it could, and the defendant sought a remand which the court declined [maybe only because the issue was clear to the court]. Society will not recognize an expectation of privacy in a fraudulent prescription. <a href=\"http:\/\/www.2dca.org\/opinions\/Opinion_Pages\/Opinion_Page_2011\/February\/February%2018,%202011\/2D09-2890.pdf\">Hendley v. State<\/a>, 58 So. 3d 296 (Fla. 2d DCA 2011).*<\/p>\n<p>The trial court\u2019s conclusion that defendant consented to a blood draw is supported by the evidence. The nurse who made the draw testified that she would not have drawn blood without some consent; it was not in writing, but it didn\u2019t have to be. <a href=\"http:\/\/www.mssc.state.ms.us\/Images\/Opinions\/CO68654.pdf\">Setzer v. State<\/a>, 2011 Miss. LEXIS 102 (February 17, 2011).*<\/p>\n<p>Defendant was stopped for a traffic offense, and an affidavit was sought for a search warrant for his BAC level. The affidavit as a whole showed probable cause, granting the deference search warrants are entitled to. <a href=\"http:\/\/www.7thcoa.courts.state.tx.us\/opinions\/HTMLopinion.asp?OpinionID=14380\">Hughes v. State<\/a>, 334 S.W.3d 379 (Tex.
