{"id":4960,"date":"2010-12-03T11:13:22","date_gmt":"2010-12-03T11:13:22","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2010-12-03T11:13:22","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=4960","title":{"rendered":"Wired: &#8220;Feds Warrantlessly Tracking Americans\u2019 Credit Cards in Real Time&#8221;"},"content":{"rendered":"<p>On Wired&#8217;s Threat Level: <a href=\"http:\/\/www.wired.com\/threatlevel\/2010\/12\/realtime\/?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+wired%2Findex+%28Wired%3A+Index+3+%28Top+Stories+2%29%29\">Feds Warrantlessly Tracking Americans\u2019 Credit Cards in Real Time<\/a>:<\/p>\n<blockquote><p>Federal law enforcement agencies have been tracking Americans in real-time using credit cards, loyalty cards and travel reservations without getting a court order, a new document released under a government sunshine request shows.<\/p>\n<p>The document, <a href=\"http:\/\/paranoia.dubfire.net\/2010\/12\/dojs-hotwatch-real-time-surveillance-of.html\">obtained by security researcher Christopher Soghoian<\/a>, explains how so-called \u201cHotwatch\u201d orders allow for real-time tracking of individuals in a criminal investigation via credit card companies, rental car agencies, calling cards, and even grocery store loyalty programs. The revelation sheds a little more light on the Justice Department\u2019s increasing power and willingness to surveil Americans with little to no judicial or Congressional oversight.<\/p>\n<p>For credit cards, agents can get real-time information on a person\u2019s purchases by writing their own subpoena, followed up by a order from a judge that the surveillance not be disclosed.
