State<\/a>, 18 So. 3d 37 (Fla. 2d DCA), review granted, 22 So. 3d 539 (Fla. 2009)), certifying the conflict to the Florida Supreme Court. <a href=\"http:\/\/www.3dca.flcourts.org\/Opinions\/3D10-0905.pdf\">State v. Fernandez<\/a>, 50 So. 3d 37 (Fla. App. LEXIS 17683 (Fla. 3d DCA November 17, 2010).*<\/p>\n<p>Officers entered with exigent circumstances to make defendant\u2019s arrest for assault, and then brought him out. The officers wanted to go back in and defendant objected. The victim could not consent under Randolph because defendant already objected. The re-entry was without justification and the observations were suppressed. <a href=\"http:\/\/www.lexisone.com\/lx1\/caselaw\/freecaselaw?searchType=citation&amp;fclSearch=2010+Ga.+App.+LEXIS+1071+&amp;action=FCLSearchCaseByCitation&amp;pageLimit=10&amp;format=CITE&amp;pageNumber=1&amp;sourceID=&amp;citation=2010+Ga.+App.+LEXIS+1071+&amp;searchTerm=\">State v. Driggers<\/a>, 306 Ga. App. 849,<br \/>\n702 S.E.2d 925 (2010).*<\/p>\n<p>Defendant was on parole, so he had an even lesser expectation of privacy than a probationer. The officers had reasonable suspicion for a home search based on his glassy eyes. United States v. Justiniano, 401 Fed.
