This issue was not timely raised in the District Court, and it is waived for appeal. <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/09\/09-5138.pdf\">United States v. Jean-Claude<\/a>, 400 Fed. Appx. 384 (10th Cir. 2010) (unpublished).*<\/p>\n<p>Defendant\u2019s traffic stop was valid, and the officer directed him out of the car. He left the door open, and the officer could see the grip of a handgun in plain view. <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/09\/09-2269.pdf\">United States v. Montes<\/a>, 400 Fed. Appx. 390 (10th Cir. 2010) (unpublished).*<\/p>\n<p>State inmate is denied a certificate of appealability <a href=\"http:\/\/www.formsworkflow.com\/d17709.aspx\">(COA)<\/a> for his habeas appeal of his Fourth Amendment claim because \u201cwe are not persuaded that reasonable jurists could disagree with the district court\u2019s conclusion that his Fourth Amendment claim was fully and fairly litigated in the Colorado state courts.\u201d <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/10\/10-1321.pdf\">Abram v.
