{"id":4695,"date":"2010-09-25T14:06:55","date_gmt":"2010-09-24T12:41:45","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2010-09-24T12:41:45","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=4695","title":{"rendered":"CA5: Jail strip search for misdemeanor hindering violated the Fourth Amendment"},"content":{"rendered":"<p>The Fifth Circuit holds that it still will require reasonable suspicion of contraband to strip search a detainee for misdemeanor hindering apprehension. <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions\/pub\/09\/09-40892-CV0.wpd.pdf\">Jimenez v. Wood County, Texas<\/a>, 09-40892 (5th Cir. September 23, 2010):<\/p>\n<blockquote><p>The County argues that it was not required to base its search of Ms. Jimenez on reasonable suspicion for two reasons. First, it argues that we should reverse our prior precedents and hold that, under <a href=\"http:\/\/scholar.google.com\/scholar_case?case=4537162703993098019&amp;q=Bell+v.+Wolfish&amp;hl=en&amp;as_sdt=400000000002\">Bell v. Wolfish<\/a>, 441 U.S. 520 (1979), the Fourth Amendment permits visual strip searches of all jail detainees upon being booked into a detention facility, regardless of reasonable suspicion. Second, the County argues in the alternative that the district court erred in classifying hindering apprehension as a \u201cminor offense,\u201d and that the nature of Ms. Jimenez\u2019s offense therefore justified the search regardless of the lack of individualized reasonable suspicion. For the following reasons, we disagree.<\/p><\/blockquote>\n<p>There has been a flurry of strip search cases this year coming to somewhat differing results in the circuits.
