{"id":4588,"date":"2011-05-02T10:29:41","date_gmt":"2010-08-26T06:57:52","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2010-08-26T06:57:52","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=4588","title":{"rendered":"OH6: Person with authority to feed the cat has no apparent authority to consent"},"content":{"rendered":"<p>The person with authority to enter defendant\u2019s house to feed defendant\u2019s cat on only three days obviously had no apparent common authority to consent to a search of the house. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/6\/2010\/2010-ohio-3922.pdf\">State v. Huntington<\/a>, 2010 Ohio 3922, 190 Ohio App. 3d 711 (6th Dist. 2010).*<\/p>\n<p>A hotel security guard\u2019s report to the police that defendant had a gun on him was justification for a patdown. United States v. Montague, 2010 U.S. Dist. LEXIS 86179 (S.D. Fla. July 27, 2010).*<\/p>\n<p>The officers had no reasonable suspicion for this stop, admittedly based on a hunch. United States v. Marcelino, 736 F. Supp. 2d 1343 (N.D. Ga. 2010)*:<\/p>\n<blockquote><p>The Government argues that the agents had the requisite reasonable suspicion to justify a Terry stop of the defendant based on three factors: (1) the officers were patrolling a well-known, high crime gang area; (2) the defendant was wearing loose, baggy clothing in colors that indicated gang membership; and (3) when the agents approached them, the two men immediately walked away and, when spoken to a second time by the agents, continued to walk away, this time even faster.\n<\/p><\/blockquote>\n<p>Defendant\u2019s stop was justified by the officer\u2019s inability to read the license plate, and he validly consented to a search of the car. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/3\/2010\/2010-ohio-3944.pdf\">State v. Bayliff<\/a>, 2010 Ohio 3944, 2010 Ohio App. LEXIS 3340 (3d Dist.
