The Supremes <a href=\"http:\/\/volokh.com\/2010\/02\/01\/final-cert-stage-briefing-in-mccane-v-united-states\/\">denied his cert petition in<\/a> <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/08\/08-6235.pdf\">McCane<\/a>. DOJ resisted in McCane, but filed its own from <a href=\"http:\/\/www.ca9.uscourts.gov\/datastore\/opinions\/2010\/03\/15\/07-30098.pdf\">United States v. Gonzalez<\/a>, 598 F.3d 1095 (9th Cir. 2010), denying rehearing en banc from <a href=\"http:\/\/www.ca9.uscourts.gov\/datastore\/opinions\/2009\/08\/24\/07-30098.pdf\">578 F.3d 1130<\/a> (9th Cir. 2009). The government&#8217;s cert petition, as usual, is more likely to be granted. <\/p>\n<p>The government didn&#8217;t want the issue heard when it was the winner, but it does when it is the loser.
