{"id":4291,"date":"2010-12-29T08:50:18","date_gmt":"2010-06-14T00:01:09","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2010-06-13T13:02:14","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=4291","title":{"rendered":"OR: General motion to suppress properly denied"},"content":{"rendered":"<p>Defendant\u2019s general motion to suppress citing only the Fourth Amendment and the state constitution with an assertion it appeared there was no probable cause was not sufficient to put the state and court on notice as to the issue to be heard in this case, and the memorandum of law filed the day of the hearing in response to the motion to strike to deny as untimely did not add anything of substance to the motion. Otherwise, there was no clear error. <a href=\"http:\/\/www.publications.ojd.state.or.us\/A138078.htm\">State v. Roth<\/a>, 235 Ore. App. 441, 234 P.3d 1019 (2010):<\/p>\n<blockquote><p>\nOn October 16, 2007, defendant filed a motion to suppress \u201call evidence that resulted from the search of the defendant&#8217;s purse.\u201d In the \u201cpoints and authorities\u201d section of the motion, defendant relied on the \u201cOregon Constitution, Article I, Section 9 and all relevant caselaw pertaining thereto.
