Brown from LA5th<\/a> is followed. <a href=\"http:\/\/www.la3circuit.org\/opinions\/2010\/04\/0407\/09-0846opi.pdf\">State v. Lewis<\/a>, 33 So. 3d 1046 (La. App. 3d Cir. 2010).*<\/p>\n<p>The search of defendant\u2019s house occurring by consent within 15-20 minutes of his unlawful stop was not sufficiently attenuated. The three <a href=\"http:\/\/scholar.google.com\/scholar_case?case=8826656230568767300&amp;q=brown+v.+illinois&amp;hl=en&amp;as_sdt=1002\">Brown v. Illinois<\/a> factors ((1) the temporal proximity of the illegal entry and the consent, (2) the presence of intervening circumstances, and, particularly, (3) the purpose and flagrancy of the official misconduct) favored the defendant. The government\u2019s alternative argument that the defendant was subject to a parole search required the officers have knowledge of the search term, and they did not. The search is suppressed.  United States v. Austin, 702 F. Supp. 2d 1021 (N.D.
