His claim is barred by <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=000&amp;invol=U10376\">Heck v. Humphrey<\/a>, aside from being untimely.  Booker v. Dominion Va. Power, 2010 U.S. Dist. LEXIS 29076 (E.D. Va. March 26, 2010).*<\/p>\n<p>Encounter with defendant in his yard was not a \u201cstop\u201d for Terry purposes, no matter what the officer called it in his own reports. There was no show of force or aggression. The officers did not block the driveway, and their lights were not on. United States v. Sullivan, 2010 U.S. Dist. LEXIS 28966 (W.D. Ky. March 24, 2010).*<\/p>\n<p>Search incident of a car for a driver\u2019s license infraction was unjustified under <a href=\"http:\/\/www.supremecourtus.gov\/opinions\/08pdf\/07-542.pdf\">Gant<\/a>. The state\u2019s effort to distinguish <a href=\"http:\/\/www.supremecourtus.gov\/opinions\/08pdf\/07-542.pdf\">Gant<\/a> as involving one suspect and here two is rejected (Belton was 4-1). There was no reason to believe they posed a threat to the officer, as he admitted on the stand. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/3\/2010\/2010-ohio-1265.pdf\">State v.
